1. What this covers
This section will identify the operator of onarc.cafe, the services these terms govern, and who is agreeing to them.
2. Eligibility and restricted jurisdictions
The consent modal already asks users to confirm they are not located in a restricted jurisdiction. This section will say which jurisdictions those are and what happens if the confirmation turns out to be untrue.
3. What the platform does and does not do
onarc.cafe is a launchpad. Tokens are created and traded by users, on-chain, on their own initiative. This section will set out that the operator does not issue, endorse, vet, or custody any token, and does not act as a broker, exchange, or adviser.
4. Risk
This section will set out the risks: total loss, no redemption right, smart contract failure, market manipulation by token creators or other users, permanent and irreversible on-chain transactions, and the absence of any deposit protection or recourse.
5. Fees
This section will describe the trading fee, how it is split between a token creator and the protocol, and the fact that a creator may redirect their share — including to token holders — at any time, affecting future fees only.
6. Your wallet and your responsibility
This section will state that users control their own keys, that the operator cannot recover or reverse anything, and that a signature made with a connected wallet is attributable to that wallet.
7. Prohibited conduct
- Impersonating another person or project.
- Market manipulation, wash trading, and coordinated deception.
- Using the platform to distribute malware or phishing links.
- Attempting to interfere with the service or other users' access to it.
8. Intellectual property
This section will cover ownership of the site and its content, and the licence users grant for material they upload — token names, images, and descriptions.
9. Disclaimers and limitation of liability
This section will contain the warranty disclaimer and liability cap. It needs to be drafted against the operator's actual jurisdiction and corporate form.
10. Changes to these terms
This section will describe how changes are published and how users are asked to re-accept. The consent record already stores a document version for exactly this purpose.
11. Governing law and disputes
This section will name the governing law and the forum or process for disputes.
